Registration Agreement

Please read this Agreement carefully. Formula Milk Maker will serve you according to the following terms and conditions.

Welcome to read the Formula Milk Maker App Platform User Agreement (hereinafter referred to as “this Agreement”). The terms and conditions set forth in this Agreement shall apply to the various tools and services provided by you using the Formula Milk Maker App platform .

1. Confirmation of Terms of Service

Formula Milk Maker App platform provides services to users in accordance with the Terms of Service and the amendments to the Terms. This service clause has the legal effect of contract law.

If you disagree with any terms of this Agreement, you may choose not to register. Once you click “Registration” and pass the registration procedure, you will accept all the terms of this Agreement voluntarily and become a registered member of Formula Milk Maker App platform. Users agree to accept all kinds of information services provided by member services while using Formula Milk Maker App platform.

2.  Modification, Interruption and Termination of Service Content

2.1 The specific service content of Formula Milk MakerApp platform is provided according to the actual situation, and has the final right to explain the services provided.

2.2 Formula Milk Maker App platform only provides relevant services to its members. The equipment related to relevant services (such as personal computers, mobile phones, and other access devices related to Internet or mobile network) and the required fees (such as telephone fees and Internet fees paid for Internet access and mobile phone fees paid for mobile network use) are borne by the members themselves.

2.3 In view of the particularity of network services, users agree that Formula Milk Maker App platform has the right to change, interrupt or terminate some or all of the network services (including toll  network services) at any time without prior notice. Formula Milk Maker App platform does not guarantee that network services will not be interrupted, nor does it guarantee the timeliness, security and accuracy of network services.

2.4 Formula Milk Maker App platform needs to periodically or irregularly repair or maintain the platform or related equipment providing network services. For instance, if network services (including toll network services) interrupts in a reasonable time due to such circumstances, Formula Milk MakerApp platform need not bear any responsibility. Formula Milk Maker App reserves the right to suspend all or part of its network services for maintenance, upgrade or other purposes without prior notice.

2.5 Users clearly agree that the risks of using Formula Milk Maker App platform network services will be borne by themselves. Users understand and accept that downloads or information, products and services obtained through the Formula Milk Maker App platform service links are automatically searched, Formula Milk Maker App platform is not responsible for its legitimacy, nor does it bear any legal responsibility. Users should take their own risks. Formula Milk Maker App platform does not make any forms of guarantees, nor does it guarantee the search results meet the requirements of users, the search service not to interrupt, or  the security, accuracy, timeliness and legality of the search results.

2.6 Formula Milk Maker App platform reserves the right to close accounts that have not been logged in for more than six months.

2.7 Formula Milk Maker Appplatform has the right to temporarily or permanently modify or terminate this service (or any part thereof) at any time, whether notified or not, Formula Milk Maker Appplatform does not have any responsibility for users and any third party.

2.8 You agree that Formula Milk Maker App platform, basing on its own considerations, shall terminate your password, account number or use of the service, and remove any content of this service for any reason, including, but not limited to, prolonged non-use, or Formula Milk Maker App platform considers that you have violated the letter and spirit of this Service Agreement. You acknowledge and agree that the services provided under any provisions of this Service Agreement could be interrupted or terminated without prior notice, and Formula Milk Maker App platform could immediately close or delete your account and all relevant information and documents in it, or prohibit to use the aforementioned documents or the Service continually.

In addition, you agree that if the use of this service is interrupted or terminated or your account number and related information and documents are closed or deleted, Formula Milk Maker App platform will not be liable to you or any third party.

3. Membership Account and Password

After the successful registration of users, Formula Milk Maker App platform will give each member an account number and the corresponding password, which will be kept by the user. The user should be liable for all activities and events carried out by his or her user account.

The platform will not take any responsibility for the illegal use of your account and password by others that is caused by hacking or negligent keeping. If you find any illegal use of your member account or security vulnerabilities, please contact our platform immediately.

4. Registration Information and Privacy Protection

4.1 The ownership of Formula Milk MakerApp platform account (i.e. Formula Milk MakerApp Platform User ID) belongs to Formula Milk Maker App platform. After the user completes the registration procedure, he or she obtains the right to use Formula Milk MakerApp platform account. Users should provide timely, detailed and accurate personal data, and constantly update the registration data, in line with the requirements. All original input data will be used as registration data. If the user registration information is not authentic,  Formula Milk MakerApp platform is not responsible for the problems and consequences caused by it.

4.2 Users are not allowed to transfer or lend their account number or password to others. You should immediately notify Formula Milk Maker App platform if you find your account has been  illegally used.

4.3 Formula Milk MakerApp platform does not disclose to the public or provide registration information for individual users to third parties unless:

• Obtain users’ explicit authorization beforehand;

• Only by revealing your personal data can the platform provide products and services you require.

• According to relevant laws and regulations;

• According to the requirements of relevant government authorities;

• To safeguard the legitimate rights and interests of the  Formula Milk MakerApp platform.

4.4 When you sign up for Formula Milk MakerApp platform account, useFormula Milk MakerApp platform products or services, or visit Formula Milk Maker App platform web page, Formula Milk Maker App platform will collect your personal identification information and use it to improve the services and content provided to you.

5. User Rights and Responsibilities

5.1 Only individuals and organizations meeting one of the following requirements can apply to become users of Formula Milk MakerApp platformand use the services under this Agreement:

5.1.1 Natural persons who have reached the age of eighteen and have the capacity for civil rights and civil conduct;

5.1.2 Natural persons under the age of eighteen but with the written consent of their guardians (including but not limited to their parents);

5.1.3 Corporations, institutions, associations and other organizations established and legally existing in accordance with Chinese laws and regulations. If a person without capacity for civil conduct or limited capacity for civil conduct, or an organization without business operation or specific business qualification is improperly registered as a user, their Agreement with the platform shall be invalid from the beginning, and the platform shall have the right to cancel the user immediately upon discovery.

5.2 Users have the right to use the various network services provided by Formula Milk MakerApp platformin accordance with the procedures and requirements of the platform. If members have objections to the service, they can contact the platform for timely resolution. 

5.3 Users must provide accurate personal data to Formula Milk MakerApp platformwhen applying for the use of theplatformnetwork services. If there is any change in personal data, it must be updated in time.

5.4 Users must agree to accept the Formula Milk MakerApp platformto send relevant business information to members by e-mail or other means.

5.5 Users must abide by the relevant laws and regulations of the People’s Republic of China when using Formula Milk MakerApp platformservice. They shall not use this service to carry out any illegal or improper activities, including, but not limited to, the following acts:

5.5.1 To produce, copy, publish, disseminate or otherwise transmit information containing one of the followings:

• Opposing the basic principles laid down in the Constitution;

• Jeopardizing state security, divulging state secrets, subverting state power and undermining state unity;

• Injuring national honor and interests;

• Inciting national hatred, discrimination and destroying national unity;

• Destroying the state’s religious policies and promoting cults and feudal superstitions;

• Disseminating rumors, disrupting social order and destabilizing society;

• Disseminating obscenity, pornography, gambling, violence, murder, terror or abetting crime;

• Insulting or slandering others and infringing upon their legitimate rights;

• Inciting illegal assembly, association, procession, demonstration, or gathering people to disrupt social order;

• Activities in the name of illegal NGOs;

• Containing false, harmful, coercive, infringing on privacy, harassment, infringement, slander, vulgarity, indecency, or other morally objectionable content;

• Containing other contents restricted or prohibited by Chinese laws, regulations and rules, as well as any norms with legal effect.

5.5.2 The Formula Milk MakerApp service shall not be used for the following activities:

• Access to computer information networks or use computer information network resources without permission;

• Delete, modify or add the functions of computer information network without permission;

• Delete, modify or add data and applications stored, processed or transmitted into computer information networks without permission;

• Deliberately create and spread destructive procedures such as computer viruses;

• Other acts that endanger the security of computer information networks.

5.6 Users who violate this Agreement or the relevant terms of service, causing any claims or losses by any third party, including reasonable attorneys’ fees, shall agree to indemnify Formula Milk MakerApp platformand its partner companies, affiliates, and protect them from damage. The platform has the right to take measures including, but not limited to, deleting the information content released by users, suspending their licenses, terminating their service, restricting their use, reclaiming their platform account number and investigating their legal liabilities hereto, depending on the nature of the users’ behaviors. For malicious registration of Formula Milk MakerApp platformaccount or using the account for illegal activities, disruption, harassment, deception to other users and other violations of this Agreement, theplatformhas the right to reclaim the account number. At the same time, the platform will assist the investigation according to the request of the judicial department. 

5.7 Users are not allowed to copy, sell, resell or use any part of the Formula Milk MakerApp platformfor any other commercial purposes.

5.8 Users should take legal liability for their behaviors while using the services of Formula Milk MakerApp platform. The forms of legal liability of users include, but are not limited to, compensation for infringed persons, and equal compensation to Formula Milk Maker App platform after Formula Milk MakerApp platformoperation company first assumes the compensation liability for administrative penalties or infringement damages caused by users’ acts.

6. Intellectual Property Rights

6.1 Formula Milk MakerApp platform and all relevant software, procedures and contents used on the website, including but not limited to works, pictures, archives, materials, website structure,  website layout, webpage design, advertisements or information presented to users via this website or advertisers, shall be legally enjoyed by the company or other owners of the right, including but not limited to copyright, trademark right, patent right or other exclusive rights, etc., which are protected by relevant laws. Without the express authorization of the company or the obligees, the user guarantees not to modify, rent, lend, sell or disseminate the website and any of the above information and resources used in this website or to make any kind of articles based on the above information and resources.

6.2 The platform grants users non-transferable and non-exclusive rights to use the website’s object code (hereinafter referred to as “software”) through a stand-alone computer, but users shall not and shall not allow any third party to copy, modify, create derivative works, restore works, reverse group interpret, or otherwise decode or attempt to decode the source code, or sell or transfer the software or re-authorize the software, or transfer any right of the software in other ways. Users agree not to modify the software in any ways or to use the modified software.

6.3 The platform has the right to label the copyright information such as “This function is provided by Formula Milk MakerApp platform” in all the function interfaces provided by the platform.

6.4 Users are not allowed to use this website through the interface provided by the non-Formula Milk MakerApp platform.

7. Other

7.1 If the performance of this Agreement is impossible, unnecessary or meaningless due to force majeure or other unexpected events, neither sides shall be liable. Force majeure referred to in this Agreement means unforeseen, unavoidable and insurmountable objective circumstances, including but not limited to war, typhoon, flood, fire, lightning or earthquake, strike, riot, statutory diseases, hacker attacks, network viruses, technical control of telecommunications sector, government actions or any other natural or man-made disasters.

7.2 The validity, performance and all matters relating to the validity of this clause and its revised version shall be subject to the laws of the People’s Republic of China. Any dispute shall be governed only by the laws of the People’s Republic of China.

7.3 Any disputes arising from this clause between the user and the platform shall be settled through friendly negotiation at first. If no negotiation can be reached, Users hereby agree to submit disputes to the people’s court of jurisdiction where the company is located for settlement. 

7.4 After the user correctly submits the information required by the registration procedure and confirms this Agreement, this Agreement shall be established and come into force between the Formula Milk MakerApp platformand the user.

7.5 Before the this Agreement coming into force, registered users can continue to use the services of Formula Milk MakerApp platformonly by using their original username and password to login on the platform website to accept and confirm this Agreement.

7.6 The validity period of the Agreement: from the time the user agrees to this Agreement or uses Formula Milk MakerApp platformto the time the user cancels Formula Milk MakerApp platformservice.

7.7 If there is no special provision in this Agreement, both parties shall contact each other by e-mail on matters related to this Agreement.

7.8 The e-mail addresses of the relevant departments of Formula Milk MakerApp platform shall be subject to the annotations on the official website.

7.9 The use of the Formula Milk MakerApp platformmeans acceptance of the platform service protocol and all its enclosures.

7.10 Formula Milk MakerApp platform reserves the right for final interpretation of this Agreement.
